E 'was published by Confindustria an interesting report on energy efficiency in Italy. The report analyzes in each area, the Italian green economy in a realistic manner, showing the trend with a prudent approach to future growth.

E quali sono i settori trainanti del rinascimento green italiano?


Massimo Beccarello, docente di economia industriale all'Università di Milano Bicocca e tra i coordinatori del rapporto, spiega che i dati sono stati ottenuti con un lavoro durato più di un anno, che ha coinvolto 200 persone e molte associazioni. Prima sono stati redatti rapporti conoscitivi settoriali sulle diverse opportunità di efficienza energetica, evidenziandone costi e benefici, ed arrivando ad individuare 9 filoni tecnologici di punta; in una seconda fase, tali elementi sono stati introdotti nel modello econometrico del Csc, ossia il centro studi di Confindustria. L'elaborazione ha consentito di stilare previsioni di crescita e di occupazione "prudenziali".
La domanda di fondo da cui lo studio è partito è "se il sistema Italia sarebbe riuscito a raggiungere l'obiettivo europeo del 20-20-20. Ovvero, al 2020, il 20% di fonti rinnovabili Final energy consumption and 20% energy savings. "

Role of Municipality in the remediation of contaminated sites in the event of a failure of the owner is not responsible for the pollution


Nell ' editorial on the site are legal in June this year, I stressed that in compravendita dei siti contaminati , strettamente correlato al tema delle responsabilità dell’inquinamento - di cui ho diffusamente parlato nelle pagine di Natura Giuridica - è quello relativo alle garanzie e alle clausole da inserire nei contratti di compravendita dei siti (potenzialmente) contaminati: la normativa in materia di bonifica dei siti inquinati, introdotta dall’art. 17 del decreto Ronchi e dal D.M. n. 471/99, infatti, ha avuto importanti riflessi sia sulla prassi commerciale, sia sulla patologia dei contratti aventi a oggetto il trasferimento di siti inquinati.

Nel caso che vi propongo oggi, analizzato dal TAR di Brescia nella sentenza n. 1313 del 2010, liberamente scaricabile dal sito di Natura Giuridica, previa semplice registrazione , il terreno contaminato era stato oggetto, in passato, di numerosi passaggi di proprietà, all’insegna dell’inconsapevolezza della situazione di contaminazione presente.
L’ultimo proprietario in ordine temporale, i seguito alla scoperta della contaminazione del sito, era stato assolto in Cassazione, per insussistenza del fatto; ciò nonostante, anche in seguito al dissequestro, il Comune in cui il terreno era ubicato aveva cominciato a notificargli una serie di provvedimenti, con cui venivano ordinati interventi diversi, ma tutti volti, sostanzialmente:

L’intervento diretto del Comune per la bonifica non presuppone, infatti, l’accertamento della responsabilità del proprietario, che non può sottrarsi allo stesso, se non provvedendovi direttamente.
